AI is transforming Pakistan’s advertising world, promising speed and innovation, but at what cost? As blurred boundaries emerge between human creativity and machine output, the question of who owns AI’s mistakes grows more urgent than ever.

Picture this: An AI tool generates a brilliant campaign visual, only for the client to discover it is a near-identical duplicate of a copyrighted design. Or worse, AI-powered content inadvertently includes culturally insensitive imagery that sparks public outrage. In the frantic rush to meet deadlines and impress clients, who bears the responsibility when artificial intelligence gets it spectacularly wrong?

Pakistan’s advertising ecosystem is embracing AI tools with remarkable enthusiasm and brilliant potential, yet with minimal consideration for the consequences when algorithms fail. The industry operates in a legal vacuum where accountability remains unclear. When AI co-creators make mistakes, it is not the algorithm that faces scrutiny; it is the agency and their client’s reputation that is on the line.

When AI Goes Rogue: The Global Wake-Up Call

The international advertising landscape offers sobering lessons. Throughout 2025, major brands have faced severe backlash when AI-generated advertisements contained biased imagery or cultural stereotypes that human oversight missed. Regulators worldwide have accelerated their response, with enforcement actions becoming routine rather than exceptional.

Globally, governments have transitioned from evaluation to active enforcement in 2025. The European Union’s AI Act ban on systems posing unacceptable risks took effect on 2 February 2025, with maximum penalties reaching $41 million or 7% of the worldwide annual turnover for non-compliance. Meanwhile, the National Conference of State Legislatures reports that in the 2025 session, all 50 US states considered AI-related measures.

The Federal Trade Commission (FTC) has escalated enforcement through “Operation AI Comply,” targeting deceptive AI claims in advertising with unprecedented vigour. Recent enforcement actions demonstrate the regulatory shift from guidance to penalties. In January 2025, the FTC required software provider AccessiBe to pay $1 million for misrepresenting its AI-powered web accessibility tool’s capabilities. The same month, IntelliVision faced a finalised FTC order barring false AI technology claims and requiring compliance reporting.

Pakistan’s Reality Check

Pakistan’s regulatory framework, however, largely predates the AI revolution. The Pakistan Electronic Media Regulatory Authority (PEMRA) and existing advertising standards primarily address traditional media violations, not algorithmic accountability. Industry conversations across agencies invariably turn to this grey area. Agencies deploy AI tools from ChatGPT to MidJourney, yet client contracts have not evolved to address AI-generated content liability. Most agencies operate on handshake agreements regarding responsibility when AI-generated campaigns fail.

This creates a perfect storm: international best practices that don’t translate directly to Pakistani law, client expectations for AI-powered efficiency, and zero legal clarity on accountability.

The Accountability Triangle: Agency, Client, and Algorithm

Three parties currently share the burden when AI-generated advertising fails: agencies bear most liability risks through existing client service agreements, despite having limited control over AI training data or algorithmic decisions. Clients remain ultimately responsible for their brand messaging and regulatory compliance, often lacking a technical understanding of AI limitations. AI providers face the least liability, typically protected by extensive terms of service that shift responsibility to users.

This imbalance creates significant vulnerability for Pakistani agencies, which often lack the legal resources of their international counterparts. Consider scenarios agencies encounter regularly: AI generates logos that unknowingly infringe on international trademarks. AI-powered sentiment analysis misreads cultural context, creating tone-deaf messaging. Automated content generation includes biased language patterns from training data, and AI-created influencer content violates advertising disclosure requirements.

Without clear legal frameworks, Pakistani agencies discover liability issues only when problems surface, creating a reactive rather than a preventive approach to AI governance. The implications extend beyond individual campaigns to broader industry credibility and consumer trust.

Building a Framework: Lessons for Pakistan

Drawing from international developments, Pakistan requires comprehensive frameworks addressing several critical areas. Mandatory disclosure requirements, following the EU model and emerging US enforcement actions, must clearly label AI content in advertising. The FTC’s recent actions against deceptive AI claims demonstrate that transparency is not optional; it is legally mandated. Rather than blanket agency responsibility, frameworks should distribute accountability based on roles: agencies responsible for oversight and implementation, clients for approval and brand alignment, and AI providers for system reliability.

Pakistan must develop AI ethics guidelines, including content verification processes and cultural sensitivity checks that algorithms consistently miss. Professional development becomes crucial, with agencies requiring formal training on AI limitations, bias recognition, and risk mitigation strategies.

Navigating the New Reality

The solution is not to avoid AI; that opportunity has passed. Pakistani agencies need proactive accountability frameworks,  starting with enhanced client contracts explicitly addressing AI usage, liability distribution, and approval processes. Internal AI governance policies requiring human oversight for culturally sensitive content become non-negotiable. Relationships with legal counsel familiar with emerging AI regulations provide essential protection.

Industry collaboration proves vital. Pakistan’s authority figures should advocate for regulatory clarity while developing self-regulatory standards to protect both agencies and consumers. The accountability gap is not merely a legal inconvenience; it is a business reality demanding immediate attention.

As algorithms become increasingly sophisticated, the stakes for establishing proper frameworks only increase. The industry faces a crossroads between innovation and responsibility. AI has already reshaped Pakistani advertising; the question becomes whether the industry will build accountability frameworks that protect creativity while ensuring ethical practice. The future of advertising depends on achieving this balance, arriving faster than legal frameworks currently accommodate.
